Time Limits and Key Filing Rules

False Claims Act (Qui Tam) cases are subject to strict filing deadlines. In general, a claim must be filed within six years of the violation, or within three years after the government reasonably should have discovered the fraud — but in no event more than ten years after the violation. Other rules also apply, including first-to-file restrictions, public disclosure bars, original source requirements, and limits on retaliation claims. Timing matters. Consulting with an experienced attorney early in the process is critical.
